Welcome to SwipeMagic! These Terms of Use (“Terms”) govern your access to and use of the SwipeMagic mobile application (“App”), developed by Brievo LLC (“we,” “our,” or “us”). By downloading, installing, or using SwipeMagic, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Acceptance of Terms

By using SwipeMagic, you confirm that you are at least 13 years old, or the age of majority in your jurisdiction, and that you have the legal capacity to enter into these Terms.

2. Use of the App

SwipeMagic is designed to help you manage your photo library by swiping left to delete photos and right to keep them. You agree to use the App only for its intended purpose and in compliance with these Terms and all applicable laws.

Prohibited Activities, You agree not to:

- Use the App in a way that violates any applicable laws or regulations.

- Attempt to reverse-engineer, decompile, or otherwise tamper with the App’s software.

- Use the App to process, store, or manage unlawful or inappropriate content.

- Engage in any activity that disrupts or interferes with the App’s functionality.

3. Privacy Policy

Your use of SwipeMagic is also governed by our Privacy Policy, which explains how we handle your data. Please review our Privacy Policy for more information.

4. Intellectual Property

All intellectual property rights in the App, including but not limited to its design, features, functionality, and content, are owned by Brievo LLC. You are granted a limited, non-exclusive, non-transferable, and revocable license to use the App solely for personal, non-commercial purposes.

You may not copy, modify, distribute, sell, or lease any part of the App or its content without prior written consent from Brievo LLC.

5. Third-Party Services

SwipeMagic includes advertisements served by AdMob, a service provided by Google. Your interaction with these ads is subject to Google’s terms and policies. We are not responsible for the content, performance, or practices of any third-party services linked through the App.

6. Disclaimer of Warranties

SwipeMagic is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, either express or implied. Brievo LLC disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the App will be error-free, secure, or available at all times.

7. Limitation of Liability

To the fullest extent permitted by law, Brievo LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App. This includes, but is not limited to, damages for loss of data, loss of profits, or device malfunction.

Our total liability under these Terms shall not exceed the amount you paid (if any) to download or use SwipeMagic.

8. Termination

We reserve the right to terminate or suspend your access to the App at our discretion, without prior notice, if we believe you have violated these Terms or engaged in unlawful behavior. Upon termination, your rights under these Terms will immediately cease.

9. Updates and Changes

We may update these Terms from time to time to reflect changes in our App or legal requirements. Any updates will be posted within the App, and the “Effective Date” at the top will be revised. By continuing to use SwipeMagic after updates, you agree to be bound by the revised Terms.

10. Governing Law

These Terms are governed by the laws of Texas, without regard to its conflict of laws principles. Any disputes arising under these Terms shall be resolved exclusively in the courts located in Texas.
